Welcome to Hinrichs Specialty Services and Technology (HSST). These Terms of Service ("Terms") govern your use of our website (hinrichsspecialtyservices.com) and our technology consulting, website services, automation, social media management, and virtual assistance (collectively, the "Services").

By accessing our website or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use our site or Services.

1. Agreement to Terms

By using our website or entering a service agreement with HSST, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and possess the legal authority to enter into a binding contract with HSST. If you are using the Services on behalf of a business or nonprofit organization, you represent that you have authority to bind that entity to these Terms.

2. Intellectual Property

All content on this website, including but not limited to text, software, graphics, designs, interactive features (such as Rive animations, canvas scripts, and chatbot systems), logos, and code, is the property of Hinrichs Specialty Services and Technology or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access our website for personal or internal business evaluation. You may not copy, modify, distribute, sell, or lease any part of our site or software code without explicit written consent from Brandon Hinrichs.

3. Services and Payments

We provide professional consulting and digital services. Approved scope, priorities, timelines, and any additional hourly work are documented in writing or in a Client Service Agreement. Website work follows the monthly plan below unless both parties agree otherwise in writing.

A. Website Care + Build

• Monthly Plan: Website Care + Build is $150 per month and includes up to five hours each month for progressive development, hosting, maintenance, security updates, routine content updates, basic SEO, and Search Console monitoring.
• Capacity and Overage: Unused hours do not roll over. Unfinished work can continue with the next month's allocation. Additional work is $30-$65 per hour and requires advance client approval.

B. Other Services

• Social Media: Social media management starts at an additional $50 per month. The final fee is adjusted according to platforms, frequency, content needs, and workload.
• Virtual Assistance and Custom Work: The scope, rate, and expected schedule are confirmed before work begins.

4. Payment Methods and Records

HSST accepts Venmo, Cash App, Zelle, check, wire, cash, or another agreed method. Payment instructions are provided directly to the client and are not published on the website. HSST records the amount, date, method, reference, and invoice association for accounting purposes. Do not send full banking credentials through website forms or ordinary email.

5. User Conduct and Responsibilities

When interacting with our website, submitting intake forms, using our client portal, or chatting with our virtual assistant, you agree not to:

• Submit false, misleading, fraudulent, or unauthorized personal or payment information.
• Use the site or Services for any unlawful purpose or in violation of local, state, or federal laws.
• Attempt to disable, bypass, or interfere with security features of our systems, including our forms and database rules.
• Transmit viruses, malware, or spam through our contact forms or chat portals.

6. Disclaimer of Warranties

OUR WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. HSST DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HINRICHS SPECIALTY SERVICES AND TECHNOLOGY AND ITS OWNER, BRANDON HINRICHS, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM YOUR ACCESS TO, OR USE OF, OUR SITE OR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO HSST DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

8. Governing Law & Jurisdiction

These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of law principles. Any legal action or proceeding relating to your access to, or use of, the website or Services shall be instituted exclusively in the state or federal courts located in Fillmore County or Lancaster County, Nebraska.

9. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make updates, we will revise the "Last Updated" date at the top of this page. Your continued use of the website or Services after such changes are posted constitutes your acceptance of the revised Terms.
